Benefit Notice - A required form or letter sent to you by the insurance company to inform you of benefits you may be entitled to receive.
Cumulative Injury - An injury that was caused by repeated incidents at work.
Discrimination Claim - A petition filed if your employer has discriminated against you or terminated you for filing a workers' compensation claim.
Employee - An individual whose work activities are under the control of an entity or single person.
Employer - The entity or individual who has control over someone's employment situation.
Independent Contractor - Some employers classify employees as an independent contractors to avoid workers' compensation. If an employer controls the manner of someone's work, has the right to fire someone, pays a salary or hourly wage, requires someone to work a specific schedule and makes deductions for Social Security or unemployment, then that person is most likely not an independent contractor.
Modified Work - When a previous job is modified to allow an injured individual the ability to continue to work.
Wage Cap - The maximum amount of an employee's earnings that are subject to the Social Security payroll tax. The amount taxed increases annually with wages.
Wage Earner - An individual who earns Social Security credits while working for self-employment income or wages.
Wages - All payment for services performed for an employer. The cash value of all monetary compensation paid to a worker in a different form other than cash is also considered wages (unless the form of payment is specifically not covered under the Social Security Act).
