Pedestrian Accidents in Michigan

Comstock Twp., MI – Woman Struck and Killed by Vehicle on Gull RdMichigan roadways have seen a troubling increase in pedestrian-related crashes in recent years. In 2023 alone, over 1,900 pedestrian crashes were reported statewide, many of them resulting in serious injuries or death. Roads like Gull Road in Kalamazoo County, with mixed residential and commercial areas, often see foot traffic even during evening hours when visibility is reduced.

When someone is hurt or killed in a pedestrian crash, it's important for families to understand the complex factors involved. Here are some considerations that often come into play in these tragic cases:

  • Nighttime Visibility Issues: Most fatal pedestrian accidents happen in low-light or nighttime conditions. Poor lighting, dark clothing, and fast-moving traffic can make it difficult for drivers to see individuals on or near the roadway.
  • Emergency Response Time: Quick medical care is crucial for pedestrian accident victims. In some cases, transport time and the severity of injuries determine survival outcomes. Paramedics and trauma centers play a vital role in responding to these emergencies.
  • Driver Responsibility: Even if a pedestrian is in or near the road, drivers must maintain awareness and take precautions. Failing to yield, speeding, or distracted driving can all lead to liability in these cases.
  • Crosswalk and Sidewalk Access: The absence of safe walking paths or clearly marked crossings can contribute to pedestrian risk. Local governments are responsible for evaluating and maintaining road safety infrastructure.
  • Legal and Insurance Complexities: Pedestrian crashes often involve questions of insurance coverage, potential wrongful death claims, and long-term financial consequences for families. Legal guidance is key to understanding your rights and next steps.
