Calculating Accident Compensation in Michigan
Motor vehicles and daily commuting are vital to our way of life, but that doesn’t lessen the devastation of car accidents. Day after day, victims’ lives are turned upside-down due to traffic accidents on local streets, multi-lane highways, and major interstates.
Thankfully, if you were hurt in an accident that wasn’t your fault, you might be able to seek compensation from the responsible party. Depending on the circumstances, you can secure a fair, full settlement to cover various damages, from medical expenses to pain and suffering.
Claiming compensation, however, requires proof of a driver’s negligence. A duty of care, the breach of that duty, causation, and damages must all be shown to succeed in a personal injury lawsuit. Needless to say, an in-depth understanding of the law and the procedures surrounding the collection and presentation of evidence is usually required to determine fault in a car accident case.
Thus, if you’ve been hurt by a careless or negligent driver in Michigan, a qualified, well-versed lawyer can assist you and yours in your quest for justice. When you retain an attorney to help you file a claim for damages, your chances of success are greatly maximized.
You might not be able to put a price on your losses just yet. You could, for instance, be familiar with the sum total of your medical expenses. But what about pain and suffering? How much money do you need to spend on medical care going forward?
An attorney can determine a reasonable settlement amount by:
- Talking to professionals in the field. To determine the value of your potential damages, your attorney may consult with medical providers and even economists.
- Compiling all of your bills and various invoices. Your attorney can use this information to calculate the monetary losses you’ve sustained due to the accident.
- Looking at previous accidents involving similar details to your case. Your attorney can use their extensive background to advise whether a proposed settlement is acceptable for your claim.
- While calculating your damages, your attorney will also evaluate your medical history, workplace records, and any other relevant documentation to determine the bigger picture.
