Lawsuits Against the Deceased in Michigan

Paradise, MI - One Dead, One Injured After Head-On Collision on S. Garfield Rd Near E. Blair Town Hall Rd

According to the state’s personal injury laws, although the person responsible for the accident died, their estate can still be petitioned for damages. In this situation, any claim for damages will be filed against the deceased’s estate.

This law becomes viable in cases where the negligent driver, or conversely, the injured victim. Was killed in the accident. A victim’s claim for economic recovery is justifiable even if one or both parties die.
